INFORMATION CLAUSE

In connection with the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, "GDPR"), we inform you about the principles of processing your personal data and about your rights related to it.

1. The administrator of your personal data is APEX LOGISTICS, headquartered in Parnowo, 76-039 Parnowo, Parnowo 34A, NIP 4990350059, REGON 389987648.

2. The personal data administrator processes your personal data based on applicable law, concluded contracts, and the consent you have given.

3. Your consent to the processing of personal data is voluntary but may be necessary to present an offer and to conclude and perform a contract.

4. In the case of processing personal data based on Article 7 of the GDPR, you have the right to withdraw your consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

5. Your personal data will be processed solely for the purpose of:


a) Performing a contract to which you are a party, based on Article 6(1)(b) of the GDPR;
b) Concluding a contract based on your interest in our offer, based on Article 6(1)(b) of the GDPR;
c) Complying with legal obligations incumbent on the Administrator, based on Article 6(1)(c) of the GDPR;
d) Preparing offer proposals, assessing customer satisfaction with the services and products offered to determine and possibly improve their quality, responding to questions, requests, complaints, and customer support, as a legitimate interest of the Administrator, based on Article 6(1)(f) of the GDPR;
e) Possible claims or defense against claims, as the realization of the Administrator's legitimate interest, based on Article 6(1)(f) of the GDPR.

6. In connection with the processing of your personal data, you have the following rights:
a) The right to access personal data, including the right to obtain a copy of such data;
b) The right to request the rectification (correction) of personal data if the data is incorrect or incomplete;
c) The right to request the deletion of personal data (the "right to be forgotten") if:
• The data is no longer necessary for the purposes for which it was collected or otherwise processed;
• The data subject has objected to the processing of personal data;
• The data subject has withdrawn consent on which the processing is based, and there is no other legal basis for processing;
• The personal data is processed unlawfully;
• The personal data must be deleted to comply with a legal obligation.
d) The right to request the restriction of personal data processing if:
• The data subject contests the accuracy of personal data;
• The processing is unlawful, and the data subject opposes the deletion of data, requesting instead its restriction;
• The Administrator no longer needs the data for its purposes, but the data subject requires them for establishing, exercising, or defending claims;
• The data subject has objected to processing until it is determined whether the legitimate grounds of the administrator override those of the data subject.
e) The right to data portability if the following conditions are jointly met:
• The processing is based on a contract with the data subject or on the consent of the data subject;
• The processing is carried out by automated means.
f) The right to object to the processing of your personal data, subject to demonstrating a legally legitimate basis overriding your interests, rights, and freedoms, particularly within the legitimate interest of the Administrator, and when the data is necessary to establish, exercise, or defend claims.
g) The right to lodge a complaint with the Office for Personal Data Protection (Office of the President of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw) if the processing of your personal data violates the provisions of the GDPR.

7. In connection with the processing of data for the purposes mentioned in point 5, the recipients of your personal data may be:
a) Public authorities and entities performing public tasks or acting on behalf of public authorities, within the scope and for the purposes arising from generally applicable law;
b) Entities within the Administrator's capital group;
c) Entities cooperating with the Administrator and providing services on its behalf, including transport companies, courier services, insurance companies, warehousing, logistics, port and airport terminals, railway operators, inspection companies, shipping lines, airlines;
d) Other entities processing personal data on behalf of APEX LOGISTICS, including law firms, IT companies.

8. Your personal data will be processed for the period necessary to achieve the purposes specified in point 5, and thereafter for the period required by generally applicable law. This period will not exceed 6 years from the end of the calendar year in which the tax obligation arose, in accordance with tax regulations.

9. Your personal data may be processed automatically and may be subject to profiling.

10. The Administrator does not plan to transfer your personal data to third countries.

11. The following principles apply starting from November 1, 2021.
